Terms of Service

♢ MY RIGHTS
I keep all rights over the commissioned artwork. I do not make artwork for commercial use. This means:
• I will NOT make artwork for free, for exposure, or for other alternative payment.
• I will NOT make artwork to be printed, redistributed, or sold as merchandise.
• I will NOT make artwork for non-fungible tokens or cryptocurrency. Uploading my art as an non-fungible token violates my rights to my intellectual property and this terms of service.
• I will NOT make artwork for training AI. Uploading my art into AI software violates my rights to my intellectual property and this terms of service.
• The artwork is my intellectual property, and as such, I retain all rights to my work.
♥ YOUR RIGHTS
• You cannot publish, make merchandise of, nor print the artwork or alterations for profit.
• You cannot upload my artwork as non-fungible tokens or into image generative artificial intelligence software.
• You can print the artwork for personal use.
• You can share the artwork on your social media, personal accounts, and websites.
• You can use the artwork for icons, blog or profile décor, cover photos, channel artwork, backgrounds or discord and twitch emoji.
• You can request to keep your name or user private when I submit the artwork online.
♦ I REFUSE TO DRAW:
• NSFW content for or of people under the age of 18.
• NSFW including noncon, semi noncon, or sexual abuse.
• Anything including or implying hate for LGBTQ+ identities.
• Anything including or implying offensive or hateful material towards communities, cultures, genders, or sexualities.
• Any artworks intended to be minted into a non-fungible token.
• Any artworks intended to be altered via AI software or to train AI software.
♢ I ACCEPT DRAWINGS INCLUDING:
• Dragons, scalies, reptilians, furries, and exotic animals.
• Armor, robots, mecha, or mechanical.
• Cyberpunk, science fiction, and high fantasy.
• Robotic limbs and robot characters.
• Elves, humans, orcs, or D&D races.
• Exotic & alien creatures.
• Monsters & demons.
• Heavy gore, body horror, fight scenes, violence, weaponry, and blood.
• Softcore NSFW or “tasteful” art
• Nudity, erotica, kinks, and other adult NSFW themes.

Commission Process

♠ THE COMMISSION PROCESS1 • Contact me by email ([email protected]), or by any of my art platforms (viioculi on bluesky, tumblr, furaffinity, discord).2 • Please use the following format or a variation of it in your initial message:
○ Commission type
○ Character references
○ Relevant character information (for example: name, personality, background, the dynamic between two characters, etc.)
○ Paypal email / number
○ (OPTIONAL) Pose references
○ (OPTIONAL) Specific details (ex. backgrounds, props, etc.)
○ (OPTIONAL) Any questions you have regarding a quote, pricing, or ToS limitations
3 • Written descriptions and/or at least 2 visual references are required. I accept fully written descriptions, but any references help tremendously!4 • Please have your references or your writing ready when you contact me.5 • Payment is 100% upfront, through a paypal invoice.6 • I will send you 3 updates; sketch, lineart, and flat coloring. Please include any alterations, changes, or details you’d like to see changed/edited/added upon update.7 • When the final artwork is done, I will send you a high resolution, unwatermarked .png file. If you’d like other versions, such as transparent, cropped, or .clip file, please let me know.

Frequently Asked

Do you accept partial payments?
Only in very special circumstances upon request or if I have a known history of previous commisions with a client.
I don't have Paypal. Do you have alternative payments systems?
If Paypal doesn't work, the only other secure method I can receive payment by is Ko-Fi.
If I change my mind after I pay the invoice without art being done, can I be refunded?
Of course. I will always honor a 100% refund if I have not started work on your commission.
If I don't like the initial sketch, can I be refunded?
You might be eligible for a partial refund. I will refund you the total amount minus an equivalent sketch pricing. If you commission a halfbody illustration costing 70 USD and request a refund after the initial sketch, I will keep the halfbody sketch equivalent of 30 USD and refund 40 USD.
Can I commission you to draw a character I don't own?
It depends. I can draw fanart and giftart if your purchase is for a friend. However, I won't draw fanart nor giftart if the request is NSFW.
What's the difference between an illustration and a scene?
An illustration is a character focused drawing without a background or the background is not the focus point of the entire picture. A scene is a background focused drawing where the character posing, perspective, interaction or shading is reliant upon a background.
My drawing "Fashion Show" is an illustration while "Bouncer" is a scene. These are similar poses, same character, same levels of shading, but "Bouncer" relies upon it's background for posing, shading, and the character interacts with the chair.
My drawing "A Warm Greeting" is an illustration while "Patience" is a scene. These are similar poses and character complexity, but "Patience" relies on it's background context for the mood, lighting, composition, and the character would not make sense without the background.
